Letter of Administration
A Letter of Administration authorizes a person to manage and distribute a deceased's estate when there is no will. Apply through the Family Justice Courts with necessary documents.
KEY DIFFERENCES
Grant of Probate and Letters of Administration
The grant of probate is applicable when the deceased left a valid will.
Valid Will
Letters of administration are sought when there is no valid will.
In a grant of probate, the executor(s) named in the will act as the legal representative(s) of the estate.
Executor/ Personal Representative
Letters of administration appoint a personal representative, usually the spouse or next of kin, to manage the estate in the absence of a will.
A grant of probate ensures that the assets are distributed according to the instructions specified in the will.
Distribution of Assets
Letters of administration distribute the assets based on the legal hierarchy outlined in the Intestate Succession Act.
